Kohl Collection is an Australian based company located on the Gold Coast in Queensland. Parcels are dispatched from our Gold Coast location.

General Conditions

Welcome to the Kohl Collection and thank your for shopping with us. Kohl Collection and our team provides services to you subject to the notices, terms and conditions as set out below. By accessing, browsing, or shopping on this website, you agree to all the terms and conditions in this agreement along with any other terms and conditions that may appear on the site from time-to-time. We reserve the right to revise these conditions at any time. We advise that you check this section periodically to be aware of any changes and your continued use of this Site shall be considered your agreement to any modified conditions. Please read them carefully. If you do not agree to these terms and conditions, please do not use the site.

Indemnity

By using this website, you the client agree to indemnify us from and against all actions, claims, suits, demands, damages, liabilities, costs or expenses (whether in tort in contract including and without limitation, negligence) arising out of or in any way connected to the use of the website by you.

Payment Processing

Ensure all contact information is correct and accurate. Payments are made via our online shop by way of your credit card or PayPal. 
Bill to address refers to your billing address your bank has on file to which statements are mailed. This may differer from your shipping address to which your items are to be sent.
In some instances order and payment verification is required. Verification will be done via email or verbally via telephone. Keep an eye on your emails or phone should we need to communicate with you.  
Shipping
Kohl Collection is an Australian based company located on the Gold Coast in Queensland. Parcels are dispatched from our Gold Coast location. 

Kohl Collection orders are packed and shipped within 48 to 72 hours of order receipt with the exception of order received on Saturday, Sunday and Australian Public Holidays. Order fulfilment is subject to stock availability and complete customer order, shipping and billing information being received by us. In the event an item is out of stock, we will inform you via email for further instruction.
Delivery charge on small items start from $9 location dependent. Delivery charge on larger items start from $17 location dependent. Freight is based on your postcode from Gold Coast and will be calculated upon checkout. Extra freight charges on bulk orders, international shipping or large items will be sent via email for client approval. These charges are calculated on an individual basis and is size and distance dependent.

Average delivery and transit time is 2-3 days. Outside metro areas allow 3-10 working days location dependent. Transit times given on this site are estimates provided by our shipping partners and should be used as a guide. Kohl Collection makes no guarantees with regard to shipping times or delays that are beyond our control. 

On checkout the system will offer various shipping options. Select the option that suits your timeline and price. Incorrect delivery details given may result in extra delivery charges. For security reasons we cannot deliver to PO Boxes or Parcel Lockers. Should your order not arrive at your Australian address within 10 business days from date of dispatch, please contact us. 

*The above does not apply to hazardous goods and international orders. Relevant shipping charges and delivery times apply and will be quoted accordingly. The recipient is responsible for all customs fees, including duty and taxes and/or international border fees. 

Redirection

Should you the client choose to redirect your parcel, this is out of the control of Kohl Collection and from that point onward will be the responsibility of the client to the new address. 

Shipping details 

Please double-check all orders, contact and personal details before submitting. Once submitted, all orders are final and cannot be canceled or amended. Your order will be shipped with the information provided by yourself the client. Should an order not be delivered or delivered incorrectly due to incorrect information supplied by you the client Kohl Collection are under no obligation to re-ship or reimburse any costs.

Kohl Collection accepts no responsibility for lost parcels as a result of incorrect or insufficient information supplied by you the client.  

Shipping a Return

  • Contact us to arrange yourreturn. Supply your order number, the item you wish to return as well as the reason for the return.  
  • Item is to be packaged securely to avoid damage during shipping. Customers are responsible for freight charges incurred due to the return of unwanted items. 
  • Kohl Collection is responsible for freight charges on incorrect items sent. 
  • Items received by a client, and then returned, is the responsibility of the client until it is returned to our address. Clients must use a reputable delivery service. 
  • In the event that the item is returned and upon inspection no fault is detected the customer is responsible for all freight charges.
  • In the event that a product or item purchased fails to meet one or more Consumer Guarantees under the Australian Consumer Law, we shall bear any costs of shipping said product back to us, as well as the shipping of a replacement product or item. 
  • The client is responsible for returning the product or item if it can easily be shipped or returned.
Processing Times
Orders will be processed and sent within 2 business days of being received. Urgent orders may be sent via email once payment has been made via our online shop. We endeavour to get urgent orders shipped on the same day. 

Orders received on public holidays will be processed during the next business day. Keep an eye out for closures during major holidays. Orders received during major holidays will be processed upon re-opening.  

You may be emailed regarding your order and product. Delayed responses will result in processing and shipping delays.
Refunds, Replacements, Returns
We offer refunds, repairs and replacements in accordance with the Australian Consumer Law and on the terms set out in our Refund Policy. Any benefits set out in this Policy may apply in addition to consumer’s rights under the Australian Consumer Law. The Australian Consumer Law provides a set of Consumer Guarantees which protect the consumers when purchasing products or services. If the Australian Consumer Law applies, then we cannot avoid the Consumer Guarantees which it provides. If there is an inconsistency between this Policy and the Australian Consumer Law , the Australian Consumer Law will prevail. Terms of Refund or Return

  • Kohl Collection offers a seven (7) day refund on all our products. 
  • Refunds may take up to 72hours to be processed. 
  • The product must not have been opened or used, and must be in resell-able condition.  
  • To be eligible for a refund, credit, repair or replacement, you must provide proof of purchase. You may be required to provide a government issued identification to qualify for a refund, repair or replacement. 
  • Credit issued will be valid for 6 months from the date of issue and will expire on the anniversary of the date of issue.

No Refunds/Returns if:

  • The returned items are used. The item is damaged due to use.  
  • The client received an item as per their request and simply has no use for it, changed their mind, or found it cheaper elsewhere.  
  • The client misused the product or item in any way that caused a problem or damage. 
  • The client was made aware of a fault before purchasing the product or item. 
  • The client insisted on a product or item for a purpose not recommended by Kohl Collection or was unclear about their needs. 
  • Wether used or unused the product or item has been in the clients possession for an extended period of time surpassing reasonable sell by or usage date. 
  • The client has been using the product or item for an extended period of time which allows for reasonable wear and tear. 

Damaged or Faulty Item Returns

  • Minor damage is subject to obligatory free repair. At the digression of Kohl Collection the item might be replaced or refunded should a repair not be viable. Damage must be reported to Kohl Collection on the day of receipt of your item.
  • Damage caused by shipping must be reported to Kohl Collection on the day of receipt of your item. Supply us with images of the damage via email, which must include original shipping packaging. It will be determined whether the items is to be returned to Kohl Collection or simply replaced. Should we require the items to be returned any replacements or refunds will be processed once the original items has been returned and received by Kohl Collection.   
  • Items with manufacturing or other major faults will be replaced or refunded. If a product or service which you purchased from us has a failure or fault which does not amount to a major failure or fault you may still be entitled to have the item repaired, replaced or a credit issued. Images of said item must be emailed to us on the day of receipt of your item and/or day of breakdown. Upon confirming that it is indeed a manufacturing fault your item will be replaced, refunded or credited. You the customer is entitled to choose a refund, replacement or credit in this situation. In the event that the item is returned and upon inspection no fault is detected the customer is responsible for all freight charges. Replacements or refunds will be processed once the original item has been returned and received by Kohl Collection. 
  • Damaged items due to customer negligence or misuse that caused a problem, or inconclusive reasoning regarding damage, will not be replaced or refunded. Used items will not be replaced or refunded. Misuse includes but is not limited to professional quality items that require training in order for the item to be used correctly. Items sold on this site is considered of a professional standard. 

Customised Item Returns

  • No refunds or replacements will be done for items that have been customised or altered on customer request, or customisation made to products by the customer. This includes but is not limited to unclear instructions by the customer pertaining to customisations or alternations.

Shipping a Return

  • Contact us to arrange your return. Supply your order number, the item you wish to return as well as the reason for the return. 
  • Item is to be packaged securely to avoid damage during shipping.
  • Customers are responsible for freight charges incurred due to the return of unwanted items.
  • Kohl Collection is responsible for freight charges on incorrect items sent.
  • Items received by a client, and then returned, is the responsibility of the client until it is returned to our address. Clients must use a reputable delivery service.
  • In the event that the item is returned and upon inspection no fault is detected the customer is responsible for all freight charges
  • In the event that a product or item purchased fails to meet one or more Consumer Guarantees under the Australian Consumer Law, we shall bear any costs of shipping said product back to us, as well as the shipping of a replacement product or item.
  •  The client is responsible for returning the product or item if it can easily be shipped or returned.

Payment Refunds

  • Unless otherwise defined at our sole discretion, we shall pay all refunds in the same form as the original purchase or to the same account, or credit card, used to make the original purchase. No cash refunds. Refunds are made to the original purchaser only. 
  • Only regular priced items may be refunded. Sale or clearance items cannot be refunded. 

Late or missing refunds

  • If you haven’t received a refund yet, first check your bank account again.
  • Then contact your credit card company, it may take some time before your refund is officially posted.
  • Next contact your bank. There is often some processing time before a refund is posted.

Good lost or damaged in transit

  • Kohl Collection will only accept responsibility for damaged or lost items/parcels if all details provided by the client along with the order is correct and appears to be truthful. 
  • Authority To Leave the parcel at your premises, ceases at the point of drop off. 
  • You the client agrees that neither Kohl Collection nor the delivery company can be held responsible for parcel theft from your premises once the parcel has been delivered. 
  • It is up to the discretion of the delivery driver on the day whether the parcel is delivered, or not, depending on how secure the delivery or delivery premises is. 
  • Lost parcels will be investigated by Kohl Collection. Upon confirmation from our shipping carrier the situation will be remedied. Allow time for this to occur.
  • Should an order not be delivered or delivered incorrectly due to incorrect information supplied by you the client Kohl Collection are under no obligation to re-ship or reimburse any costs.
  • Kohl Collection accepts no responsibility for lost parcels as a result of incorrect or insufficient information supplied by you the client.  

Cancelling, Amending Orders
Please double-check all orders, contact and personal details before submitting. Once submitted, all orders are final and cannot be canceled or amended. Your order will be shipped with the information provided by yourself the client. 

Should you for any reason wish to cancel your order contact us via email on info@kohlcollection.com.au. If your order has not yet been shipped we will process the cancellation with no penalty. Should your order already be shipped return your unopened, unused items to us. Freight charges are for the customers account. Goods returned in resell-able order will be refunded. We recommend images of the returned items be sent via email to us prior to returning the item to confirm good resell-able condition. Goods returned due to order cancellation and received by Kohl Collection damaged will not be refund as once the customer has manually handled the item the condition of the item is the customers responsibility. 

*Under certain circumstances Kohl Collection reserves the right to cancel and refund any order we see fir without reason.
Product Information
Our store endeavours to be as accurate as possible. However, Kohl Collection does not warrant that product descriptions and website content is always accurate, free of errors, complete or current. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice. We are under no obligation to update, amend or clarify information in the Service or on any related website, including but not limited to, pricing, except as required by law.

If any product ordered from Kohl Collection that you receive isn’t described as shown on Kohl Collection store, it can be returned – unused – as described in our returns policy.
Liability Limitations
We do not guarantee, represent, or warrant that the use of our service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that your use of, or inability to use, the service is at your own risk. The service and all products and services delivered to you through the service are provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.   

In no case shall Kohl Collection, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors, be liable for any injury loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including but not limited to lost profits, lost revenue. Lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort, strict liability or otherwise, arising from your use of any of the services or products acquired using the service, or for any other claim related in any way occur during use of the service or product, including but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

All copyrights, trademarks and other intellectual property rights in the design, layout and, working and concepts of this site are reserved to Kohl Collection. Trademarks, copyrights, brand names, product names related to the products appearing on this site are the property of their respective owners. Kohl Collection does not claim to own any of these trademarks, copyrights, brand, or product names what-so-ever nor does it claim that Kohl Collection is related to, endorsed by or in any other way connected or associated with the respective owners, related companies, or agents.  
Stock, Back Orders, Discontinued
We aim to always have ample stock of all items however, if products go backorder or is discontinued without or knowledge, we will contact your via email. You the client must via written email confirm wether you wish to receive a refund or am happy to wait for the item/s. 

Where items have been discontinued you the client may select a refund, swop or store credit. Credit issued will be valid for 6 months from the date of issue and will expire on the anniversary of the date of issue.
